Participant Liability Waiver + Mandatory Media Release (Discovery Workshops)

IMPORTANT — READ BEFORE SIGNING

Freeboarding / riding a FREEBORD board involves inherent risks, including serious injury or death. By signing this waiver, you confirm you understand these risks and agree to the terms below.

1. Parties

This Participant Liability Waiver and Media Release (“Waiver”) is entered into between:

1. Participant (“you”) — the person taking part in the session; and
2. Facilitator / Instructor — the independent certified Freebord Journey facilitator delivering the session (the “Facilitator”); and
3. Mamello GmbH (“Platform Operator”), Sankt-Wendel-Str. 46, 81379 Munich, Germany, operating the Freebord Journey booking platform and certification program.

2. Activity covered

This Waiver applies to participation in a Freebord Journey “Discovery” workshop / initiation session (the “Session”), which may include:

• riding instruction and supervised practice
• use of FREEBORD boards and related equipment
• warm-up, drills, and basic riding exercises
• photo/video recording during the Session

3. Acknowledgement of risk

3.1 Inherent risks. You understand that the Session involves risks including, but not limited to: falls, collisions, loss of control, equipment failure, road surface hazards, weather conditions, and actions of other people.

3.2 Your responsibility. You agree to ride within your limits, follow instructions, and stop immediately if you feel unsafe.

4. Health and fitness declaration

You confirm that:

• you are physically and medically fit to participate
• you are not under the influence of alcohol, drugs, or medication that may impair coordination or judgment
• you will inform the Facilitator of any relevant medical conditions or injuries before the Session

5. Mandatory protective gear

You agree that the following protective gear is mandatory for the Session:

• helmet
• wrist guards or gloves
• knee pads
• elbow pads

If you refuse to wear mandatory protective gear, you may be denied participation without refund (subject to applicable law and the booking terms).

6. Instructions and conduct

You agree to:

• follow the Facilitator’s safety briefing and instructions at all times
• stay within the designated practice area
• not attempt tricks, high speed riding, or unsafe maneuvers during a Discovery Session
• treat other participants and the public respectfully

The Facilitator may stop your participation if they believe you are acting unsafely.

7. Equipment use

7.1 Use at your own risk. You understand that equipment is provided “as is” for the Session.

7.2 Report issues. You will immediately report any equipment issues to the Facilitator and stop using the equipment until cleared.

8. Mandatory photo/video recording + media release

8.1 Recording is a condition of participation. You understand and agree that photo and video recording is mandatory during the Session. If you do not agree, you must not participate in the Session.

8.2 Permission to use your image/voice. You grant the Platform Operator and the Facilitator a non-exclusive, worldwide, royalty-free, transferable (to service providers), sublicensable right to use, reproduce, edit, publish, and distribute your image, likeness, voice, and any recordings made during the Session (“Recordings”) for:

• marketing and promotional content (website, social media, ads)
• community content (community platform, newsletters)
• educational content (course material, tutorials)

8.3 No compensation. You agree you will not receive compensation for the Recordings.

8.4 No approval required. You waive any right to inspect or approve the finished Recordings.

8.5 Respectful use. We will not knowingly use Recordings in a misleading or defamatory way.

9. Release of liability

9.1 Release. To the fullest extent permitted by law, you release and hold harmless:

• the Facilitator (as the on-site service provider), and
• Mamello GmbH / the Platform Operator (as the platform and certification provider)

from claims arising out of your participation in the Session, including injury, loss, or damage, except where caused by intent or gross negligence, or where liability cannot be excluded under mandatory law.

9.2 Third-party claims. You agree to be responsible for damage you cause to third parties or property due to your intentional or negligent actions.

10. Age requirement (18+) and minors

10.1 Minimum age. The Session is intended for participants 18 years or older.

10.2 Minors only with written parental consent. If the Participant is under 18, a parent/legal guardian must provide written consent and sign below before the Session starts. Without written consent, the minor may not participate.

11. Governing law

This Waiver is governed by the laws of the Federal Republic of Germany, while preserving mandatory consumer protection rules that may apply in the Participant’s country.

12. Severability

If any provision is found invalid, the remaining provisions remain in effect.
