On-site Initiation / Discovery Terms (Booking & Participation)

1. Scope and relationship to the Master Terms

These On-site Initiation / Discovery Terms (“Workshop Terms”) apply when you book or participate in an in-person FREEBORD / Freebord Journey initiation or discovery session (“Session”) through our Platform.

These Workshop Terms are Service Terms under the Master Platform Terms & Conditions (“Master Terms”). If these Workshop Terms conflict with the Master Terms, these Workshop Terms prevail for Sessions.

2. Who provides what (Platform vs. Facilitator)

2.1 Platform operator. The Platform is operated by Mamello GmbH (“we”, “us”). We provide the booking and payment flow and we set minimum standards for Sessions.

2.2 Independent Facilitators. Sessions are delivered on-site by independent third-party facilitators (“Facilitators”). Facilitators are not employees, agents, or representatives of Mamello GmbH.

2.3 Your contract for the Session. Your booking is made via the Platform. The on-site service itself is performed by the Facilitator.

3. Booking, payments, and refunds

3.1 Booking confirmation. A booking is confirmed only after full payment is received.

3.2 Refunds (general). Unless otherwise required by law, refunds are not provided once a booking is confirmed.

3.3 If a Session cannot take place. If a Session cannot take place due to the Facilitator or the rider, the Session will be rescheduled.

3.4 EU consumer withdrawal (online booking). If you are an EU consumer booking online, you may have a statutory right to withdraw within 14 days unless the Session occurs within this period or has started with your express consent.

4. Rescheduling and cancellations

4.1 Attendance. Riders are expected to attend Sessions at the time and date booked.

4.2 Rescheduling by rider. Rescheduling is considered only in exceptional circumstances and must be arranged via the Platform and/or directly with the Facilitator (as shown at booking).

4.3 Facilitator cancellation. If a Facilitator cancels, the Session will be rescheduled.

5. Safety and conduct

5.1 Inherent risk. Freeboarding involves inherent risks of falls and injury.

5.2 Follow instructions. You must follow safety instructions provided by the Facilitator at all times.

5.3 Mandatory protective gear. Wearing a helmet is mandatory. Additional protective gear (wrist guards/gloves, knee and elbow pads) is mandatory unless stated otherwise at booking. A spine protector is strongly recommended.

5.4 Code of conduct. Riders must behave respectfully and comply with Community rules and Facilitator instructions. We reserve the right to exclude participants for inappropriate conduct or safety violations.

6. Insurance

You are responsible for your own insurance coverage, unless otherwise stated at booking.

7. Participant Waiver (required)

You must sign the Participant Waiver / Assumption of Risk before participating in any Session. If you do not sign, you cannot participate.

8. Liability (high-level)

8.1 Legal baseline. Nothing in these Workshop Terms limits liability for intent/gross negligence or mandatory consumer rights.

8.2 No blanket exclusion. To the extent permitted by law, Mamello GmbH is not liable for injuries, accidents, or material damage resulting from participation in Sessions, except where we are legally responsible.

8.3 Facilitator responsibility. The Facilitator is responsible for on-site supervision, instruction, and local compliance.

9. Photos and videos

By participating, you agree that photos/videos taken during Sessions may be used for communication, promotion, and marketing purposes, unless you opt out in writing before the Session.

10. Data protection

Personal data is processed according to our Privacy Policy (to be linked on the Platform).

11. Governing law and jurisdiction

These Workshop Terms are governed by the laws of the Federal Republic of Germany, excluding the CISG, while preserving mandatory consumer protection rules.

12. Changes

We may update these Workshop Terms from time to time. Material changes will be communicated via email or platform announcement.

13. Language

In case of discrepancies between translations, the English version prevails.
